UTC sets a procedural schedule on a commission complaint against Waste Management of Washington, Inc. d/b/a Waste Management of Greater Wenatchee

A prehearing conference was held at UTC headquarters in Olympia on November 9, 2009, at 10:00 a.m. The commission entered a prehearing conference order (Order 01) and set the following procedural schedule:

  • Company Initial Filing - Due December 2, 2009
  • Staff Responsive Filing - Due December 16, 2009
  • Company Reply - Due December 23, 2009

Background
The commission has issued a complaint for penalties in the amount of $64,140 against Waste Management of Washington, Inc., d/b/a Waste Management of Greater Wenatchee for billing its customers improper charges. Based on a review of the Declaration of Carlene Hughes and Staff Investigation Report of Waste Management, the commission finds probable cause exists to issue this Complaint.

Commission staff requests that the commission find that each bill issued by Waste Management to each customer containing a charge or charges not included in the company's tariff constitute a violation of RCW 81.28.080, and that the commission , pursuant to its authority in
RCW 81.04.380, assess penalties of $10 for each violation of RCW 81.28.080, totaling $64,140. (Docket 091127, see "Documents" link below for more information.)
