The commission enters its final order on a petition for closure of the Logen Road grade crossing.

The commission enters its final order on November 30, 2009. In this Order, we grant Burlington Northern Santa Fe’s petition for administrative review and modify the conditions in the Initial Order relating to the order in which the railroad must close the crossing, upgrade the 300th Street NW / Dettling Road crossing and construct the turnaround at Logen Road. We deny the railroad’s petition to reopen the record as unnecessary.

A Petition for Administrative Review on behalf of BNSF was filed on November 10, 2009. A response to the petition for administrative review was filed by Commission Staff on November 19, 2009.

Background History:
The commission held a prehearing conference on February 13, 2009, at 1:30 p.m., on a petition by BNSF Railway Company for the closure of the Logen Road grade crossing in Snohomish County. A procedural schedule including a heard date and public comment hearing date has been established.

The commission held evidentiary hearings in this matter beginning March 30, 2009, at 9:00 a.m., in the Snohomish County Public Utility District No. 1's Stanwood Office, 9124 - 271st Street NW, Stanwood, Wa. In addition, the commission held a public comment hearing in this matter on March 30, 2009, at 6:00 p.m., also in the Snohomish County PUD No. 1's Stanwood Office. (Docket TR-090121. On October 21, 2009, the commission issued Order 03 - Initial Order Granting Petition to Close Logen Road Grade Crossing Subject to Conditions.
