The commission has adopted new rules, WAC 480-109, related to Electric Companies-Acquisition of Minimum Quantities of Conservation and Renewable Energy as Required by the Energy Independence Act (Chapter 19.285 RCW).
The rules in WAC 480-109 establish the procedures investor owned utilities must follow to demonstrate compliance with the statutory requirements, state penalty provisions, and include reporting and public notification requirements. The commission filed an Order Adopting Rules Permanently with the Code Reviser on November 27, 2007. It will be effective on December 28, 2007.
Recently, the commission learned that some changes to the rules reflected in the adoption order was erroneously omitted from the rules. To correct these errors, the commission filed a Correction Order with the Code Reviser on December 10, 2007. (Docket UE-061895, see "Documents" link below for more information.)

BACKGROUND:
The commission filed a Proposed Rulemaking (CR-102) with the Code Reviser's Office on August 21, 2007, on final draft rules that would establish the procedures investor owned utilities must follow to demonstrate compliance with the statutory requirements, and establish penalty provisions, as well as reporting and public notification requirements. The commission held an adoption hearing on Wed., Oct. 24, 2007, at 1:30 p.m. at UTC headquarters in Olympia.
