The Commission adopts permanent rules to implement the requirements of RCW 80.80.060 regarding electrical company compliance with the greenhouse gases emissions performance standard contained in RCW 80.80.040. The rules govern electric company filings and process regarding Commission enforcement of the Greenhouse Gases Emission Performance Standard. The Commission filed its Adoption Order with the Office of the Code Reviser on November 14, 2008. The rules will be effective on December 15, 2008, the 31st day following filing.
Background:
The Commission filed a Preproposal Statement of Inquiry (CR-101) with the Code Reviser on February 5, 2008.
On May 3, 2007, the Governor signed Engrossed Senate Substitute bill 6001, Chapter 307, Laws of 2007, with the title Climate Change - Mitigating Impacts. The law became effective July 22, 2007, and is codified at RCW 80.80. RCW 80.80.060(9) requires that the Commission adopt its rules by December 31, 2008.
The Commission filed a Proposed Rulemaking (CR-102) with the Code Reviser's Office on August 20, 2008, on final draft rules to implement the requirements of RCW 80.80.060 regarding electrical company compliance with the greenhouse gases emissions performance standard contained in RCW 80.80.040. The proposal would govern electrical company filings and process regarding Commission enforcement of the Greenhouse Gases Emissions Performance Standard established in RCW 80.80.040.
The Commission invites written comments on the proposed rules by September 22, 2008. The Commission has set an adoption hearing for Thursday, October 23, 2008, at 10:00 a.m. at UTC headquarters in Olympia.
