The commission adopts permanently certain adoption by reference rules and makes other minor administrative changes to WAC 480-62-235, WAC 480-62-240, WAC 480-62-999, WAC 480-75-999, WAC 480-93-999, WAC 480-100-999, WAC 480-108-999, and WAC 480-120-401. The commission filed General Order R-557 with the Code Reviser on January 14, 2010. The rules will be effective on February 14, 2010. Further, the commission filed a CR-102 with the Code Reviser's office on January 20, 2010, on a final draft rule to amend WAC 480-120-999 Adoption by reference. The commission invited written comments on the proposed rule by February 22, 2010. The commission received one comment to the CR-102. The commission held an adoption hearing on WAC 480-120-999 on Thursday, March 11, 2010, at 1:30 p.m. at UTC headquarters in Olympia. The commission filed General Order R-558 with the Code Reviser on March 19, 2010, amending and adopting WAC 480-120-999.
BACKGROUND:
The commission has begun an expedited rulemaking (CR-105) for its annual update of "Adoption-by-reference" rules. The proposal would revise adoption-by-reference dates to reflect the most current published versions of adopted federal rules and other adopted publications as well as make other minor administrative changes. Adoption-by-reference rules are federal laws or other standards that the UTC has adopted by referring to them in its rules. Comments on the rules or expedited rulemaking (RCW 34.05.353) are due by December 8, 2009.
The commission received one comment related to WAC 480-120-999. Under the expedited rulemaking statute, RCW 34.05.252, if a written notice of objection to the expedited rulemaking is timely filed and is not withdrawn, the notice of proposed expedited rulemaking is considered a statement of inquiry (CR-101). In order to allow the remaining rules noticed in the CR-105 to go forward without delay, the commission will proceed by adopting the rules noticed in the CR-105 with the exception of WAC 480-120-999, which will proceed to a Proposed Rulemaking (CR-102).
