WUTC confirms order requiring Verizon to honor terms of an out-of-state interconnection agreement

The WUTC on April 4, 2002, denied a request by Verizon Northwest, Inc., to reverse an administrative law judge's decision requiring Verizon to make available an interconnection agreement from North Carolina that was requested by Focal Communications.

The initial order, issued in November 2001, concluded that Focal was entitled to get the same interconnection terms from Verizon that Verizon offered in other states.

Under Sec. 252(i) of the federal Telecom Act of 1996, competitive local exchange companies like Focal are entitled to adopt interconnection agreements negotiated by other companies. Verizon argued that this right was limited to other agreements within the same state.
