Court enforces cease and desist order against All My Sons Moving & Storage of Seattle

OLYMPIA, Wash. – Thurston County Superior Court handed consumers a victory today by signing a consent decree preventing a Kent-based residential moving company from doing business in Washington state.
Under the consent decree, All My Sons Moving and Storage of Seattle, Inc. (All My Sons Seattle) may not conduct an in-state residential moving business. The company is also enjoined from using advertisements, including Web sites, to promote in-state residential moving services within Washington.
In February, the Washington Utilities and Transportation Commission (UTC) asked the court to enforce a November 2008 UTC order against All My Sons Seattle that canceled the company’s permit to operate an in-state moving business, and ordered the carrier to cease and desist providing in-state moving. In that order, the UTC found that the moving company had repeatedly overcharged customers, inaccurately estimated the costs of customers’ moves and mishandled customers’ damage claims. The UTC also found that the mover repeatedly violated numerous state laws and rules governing moving companies. The UTC had received 60 customer complaints regarding All My Sons Seattle, more than any other permitted residential moving company in the state.
In its February court filing, the UTC alleged that All My Sons Seattle did not cease residential moving operations within the state after the UTC cancelled its permit, citing continued advertising by the company and a specific customer complaint about a move that took place after the company’s cancellation.
Neither All My Sons Seattle, nor any All My Sons affiliate, is currently permitted to provide in-state residential or commercial moves in the State of Washington. All My Sons Seattle has filed to dissolve the corporation, and is in the process of liquidating the business.
The UTC is the state’s watchdog agency in charge of enforcing consumer protection and safety regulations for more than 200 residential moving companies operating within the state. Movers are required to get a permit from the UTC, charge proper rates, carry proper insurance and keep their vehicles safely maintained. The commission does not regulate interstate moving companies.
